Under the Building Safety Act and the amended Building Regulations 2010, dutyholders are now subject to strict legal responsibilities for ensuring building safety and regulatory compliance throughout a project’s lifecycle. This includes Clients, Principal Designers, and Principal Contractors, each of whom must demonstrate clear understanding, action, and evidence in discharging their duties.

Not all projects require enevo to hold a statutory dutyholder role. We are frequently appointed to support existing dutyholders in an advisory or administrative capacity, providing technical expertise, submission coordination, and compliance assurance without assuming legal responsibility unless formally appointed.

Where we can support without holding the duty

enevo regularly supports projects where statutory dutyholder roles are already appointed, but additional expertise, capacity, or independent oversight is needed to strengthen compliance and reduce approval risk.

In these situations, we act alongside dutyholders to support delivery, coordination, and regulator engagement, without transferring statutory responsibility.

This includes support as:

  • Advisor to the Building Regulations Principal Designer (HRB and non-HRB projects)

  • Advisor to the Principal Contractor on Building Regulations compliance

  • Client-side support for Gateway 2 and Gateway 3 submissions

  • Technical administration and coordination of Building Safety Regulator submissions

Advisory roles do not carry statutory responsibility. Legal duties remain with the appointed dutyholders. enevo’s role within these appointments is to provide expert technical input, coordination support, and evidence-led advice to strengthen compliance outcomes.

Dutyholder Role Clarification
We start by mapping your project structure and clarifying which parties carry duties under the Building Safety Act and Regulations 11A - 11O. Where enevo is not appointed as the BRPD, we support existing dutyholders by reviewing role definitions, interfaces, and evidence requirements.

We review existing procedures, identify gaps, and provide a tailored compliance roadmap that reflects project type, risk profile, and regulatory requirements.

Coordination and Risk Tracking

Documentation Oversight
We coordinate the preparation, review, and sign-off of Gateway 2 and 3 submission documents, including design declarations and competency evidence. Where acting in an advisory capacity, enevo supports document preparation, quality checks, and submission readiness without acting as the submitting dutyholder.
