Planning works to an existing higher-risk building can be difficult to navigate.

The rules are very detailed. The approval route depends on the type of work, the building, whether the work falls within the higher-risk building regime, and the BSR’s requirements as the Building Control Authority. Where plan checks or site inspections are required, the BSR may involve appropriately registered inspectors, including Class 2C or 2F RBIs where the work falls within their permitted scope.

What types of work this may relate to

For in-scope higher-risk building work, the Building Safety Regulator remains the Building Control Authority. The GOV.UK Code of Conduct confirms that Class 2C and 2F Registered Building Inspectors may carry out defined permissible work on existing HRBs when acting on behalf of the regulatory authority, where it is the building control authority.

This may include certain internal layout changes within a residential unit, provided no other Category A work is involved, and Category B work as defined under the higher-risk building procedures.

The BSR remains responsible for the building control approval process.

Frequently Asked Questions

Can Class 2C and 2F inspectors work on existing HRBs?

GOV.UK states that Class 2C and 2F RBIs can carry out permissible work on existing HRBs on behalf of the regulatory authority when it is the building control authority. The scope is limited and should be reviewed against the proposed works.

What is Category B work on an HRB?

Category B work is defined in Regulation 12(6) of the Building (Higher-Risk Buildings Procedures) (England) Regulations 2023. The practical impact depends on the specific proposed works, so the scope should be checked before proceeding.

Does this mean all HRB work can be handled by a Class 2C or 2F inspector?

No. The GOV.UK wording is limited to permissible work on existing HRBs. Wider HRB works may require different competence, approval routes or BSR involvement.
